One Copy of Notice Erected on Site
Thesite notice form is available from the planning authority and only notices in this prescribed format are acceptable. The notice must be securely fixed near the main entrance to the land and other entrances or parts of the site adjoining the public road so as to be clearly legible to persons using the public road/street and shouldnot be obscured or concealed at any time.
Where there is more than one entrance from public roads, further site notices must be erected on or near such entrances or on any part of the land or structure adjoining a publicroad.
The notice should be completed in indelible ink on a white background and affixed to a rigid durable material, which has been weather proofed.
Where a VALID planning application is made in respect of any land or structure, and a subsequent application is made within 6 months from the date of making the first-mentioned application in respect of land substantially consisting of the site or part of the site to which the first-mentioned application related, the site notice for the subsequent application shall be inscribed or printed in indelible ink on a yellow background.
Where a planning application requires a yellow site notice, a yellow site notice must be submitted to the planning authority with the planning application.
Where a planning application is invalidated, the site notice for the subsequent planning application will remain on a white background as the previous planning application was an incomplete planning application and is no longer valid.
The site notice must be maintained in position on the land or structure for a period of 5 weeks from the date of receipt of the planning application by the planning authority and shall be renewed or replaced if it is removed or becomes defaced or illegible within that period.
The site notice is required to be placed within the period of two weeks, prior to the making of the application.
In calculating these time limits, and all time limits specified in the legislation, periods are calculated by reference to the Interpretation Act and are reckoned to include the day from which the period is to run.
Thus, a week will run from Tuesday in one week to Monday of the following week.
Accordingly, if the site notice and newspaper notices are placed on a Thursday, the planning application must be received in the Planning Authority before the end of the following Wednesday week
The site notice must not be placed on a gate or splayed entrance wall.
