Refusal of Permission



The Planning Authority may refuse permission if the application for the development does not fulfil the planning criteria e.g. if the proposed development would be prejudicial to public health or if the proposed development would constitute undesirable ribbon development. The notification of refusal of permission outlines in details the reason(s) for refusal. The applicant or third party, who made a valid submission within the first five weeks of the planning application may appeal the decision of the Planning Authority to An Bord Pleanala within four weeks of the making of a decision by the Authority. The appeal must be accompanied by the prescribed fee and in the case of appeals by a third party must also include the acknowledgement letter issued by the Planning Authority to the third party when the initial submission or objection was made.
