Conditions to be complied with ‘Prior to the Commencement of Development’

When imposing conditions on the grant of planning permission the Planning Authority may sometimes specify that certain conditions must be complied with ‘Prior to the Commencement of Development’,for example: the payment of a contribution fee, or the submission of a landscaping scheme which may need to be submitted and agreed with the Planning Authority in advance of the development commencing.

It is important to note that the onus is on the applicant to ensure that all conditions and, in particular, those which require compliance prior to the commencement of development are complied with. Please note that the onus is also on you to supply the Planning Authority with such details in advance to provide adequate time for consideration by the Planning Authority and in turn prevent delays in the commencement of the development
